Waiver & Release of Liability

The Well Retreat – Hosted by The Seek Movement

Event Dates: March 6, 2026 at 9:00am through March 8, 2026 at 3:00pm

Location: North Fort Myers, Florida

Please read this Waiver & Release of Liability carefully. By registering for and participating in The Well Retreat, you acknowledge that you have read, understood, and voluntarily agreed to the terms below.

1. Acknowledgment of Risk

I understand that participation in The Well Retreat, hosted by The Seek Movement, may involve activities including but not limited to walking on uneven ground, hiking, outdoor environments, worship gatherings, creative workshops, shared meals, group discussions, and other optional activities.

I acknowledge that these activities involve inherent risks, including but not limited to:

Slips, trips, and falls
Uneven terrain and outdoor conditions
Weather exposure including heat, humidity, rain, or wind
Allergic reactions including food, insect stings, or environmental factors
Illness, injury, or physical strain
Emotional or physical discomfort

I voluntarily choose to participate with full knowledge and acceptance of these risks.

2. Voluntary Participation & Personal Responsibility

I affirm that I am physically, emotionally, and mentally capable of participating in this retreat.

I understand that:

All activities are optional
I am responsible for knowing my limits and choosing activities accordingly
I agree to follow all safety instructions, guidelines, and directions provided by retreat staff, volunteers, or facilitators

3. Release & Waiver of Liability

To the fullest extent permitted by Florida law, I hereby release, waive, and forever discharge the following parties from any and all claims, demands, actions, or causes of action, whether known or unknown:

The Seek Movement, including its founders, directors, officers, board members, employees, volunteers, agents, contractors, and representatives
The property owner(s), landholder(s), or host(s) of the retreat location
Any affiliated individuals or organizations involved in planning, hosting, or facilitating the retreat

This release includes claims arising from ordinary negligence, including but not limited to personal injury, illness, emotional distress, property damage, or loss occurring during or related to my participation.

This waiver does not apply to gross negligence or intentional misconduct, which are not waivable under Florida law.

3A. Florida Landowner Protection Notice

I understand and acknowledge that the property owner(s) are allowing use of their land for this retreat in connection with a charitable and religious activity and do not guarantee the safety of the premises or conditions.

I voluntarily assume all risks associated with being on the property, including natural conditions, terrain, wildlife, weather, and structures, whether obvious or hidden.

This acknowledgment is made pursuant to Florida Statute §375.251, relating to landowner liability for recreational or charitable use of land.

3B. No Duty to Inspect or Warn

I understand that the property owner(s), landholder(s), or host(s) of the retreat location have no duty to inspect the property, make improvements, or provide warnings regarding dangerous conditions, structures, or activities on the premises beyond what is required by Florida law.

I knowingly waive any claim based on a failure to inspect, warn, or safeguard against conditions on the property.

4. Assumption of Risk

I knowingly and voluntarily assume all risks associated with participation in The Well Retreat, including risks arising from the actions or omissions of other participants.

I understand that my participation is entirely voluntary and undertaken at my own risk.

5. Medical Treatment Authorization

In the event of an accident, illness, or medical emergency, I authorize The Seek Movement, its staff, or volunteers to obtain emergency medical treatment on my behalf.

I understand that:

I am responsible for all medical expenses incurred
The Seek Movement does not provide medical or health insurance coverage

6. Indemnification

I agree to indemnify and hold harmless The Seek Movement, the property owner(s), landholder(s), host(s), and all associated parties from any claims, damages, losses, liabilities, or expenses, including attorney’s fees, arising from:

My participation in the retreat
My actions or omissions
My failure to follow retreat policies, guidelines, or instructions

7. Participant Conduct

I agree to conduct myself in a respectful and safe manner at all times.

I understand that The Seek Movement reserves the right to remove any participant whose behavior is unsafe, disruptive, or inconsistent with the values of the retreat, without refund.

8. Transportation Disclaimer

I understand that The Seek Movement does not provide transportation and is not responsible for accidents or incidents occurring while traveling to or from the retreat or during any off-site activities.

9. No Guarantee of Outcomes

The Well Retreat is a Christ-centered experience focused on spiritual reflection, rest, and community.

I understand that no guarantees are made regarding spiritual, emotional, physical, or personal outcomes.

10. Photo & Video Release

Unless otherwise indicated during registration, I grant permission for photographs and video recordings taken during the retreat to be used by The Seek Movement for ministry, educational, or promotional purposes, without compensation.

I understand that I may indicate my photography and video consent preferences during registration and that reasonable efforts will be made to honor those selections.

11. Governing Law & Severability

This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

If any portion of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Arbitration & Waiver of Jury Trial

Any dispute arising out of or relating to this agreement or participation in The Well Retreat shall be resolved by binding arbitration in Lee County, Florida, in accordance with Florida law.

I knowingly waive my right to a jury trial or to participate in a class action lawsuit.

13. Acknowledgment of Agreement

By checking the agreement box during online registration and completing payment, I acknowledge and agree that:

I have had the opportunity to read this Waiver & Release of Liability in full
I understand its terms and conditions
I understand that I am giving up certain legal rights, including the right to sue for ordinary negligence
I voluntarily agree to be legally bound by this agreement
I understand that checking the agreement box at registration checkout, constitutes my electronic signature and is legally binding under applicable law
